Waiver & Release of LiabilityLFG Mobile Golf LLC

By participating in any activity provided by LFG Mobile Golf LLC, including but not limited to use of golf simulators, golf clubs, golf balls, hitting mats, enclosures, generators, and related equipment, I acknowledge and agree to the following:

Assumption of Risk

I understand that participation in golf-related activities involves inherent risks, including but not limited to personal injury, property damage, illness, or other loss. These risks may arise from my own actions, the actions of others, equipment malfunction, uneven surfaces, weather conditions, or other foreseeable and unforeseeable causes. I voluntarily assume all such risks.

Release and Waiver of Liability

To the fullest extent permitted under Virginia law, I hereby release, waive, and discharge LFG Mobile Golf LLC, its owners, officers, employees, independent contractors, agents, affiliates, and venue partners from any and all claims, demands, actions, causes of action, damages, or liabilities of any kind, whether known or unknown, arising out of or related to my participation, including claims arising from the ordinary negligence of LFG Mobile Golf.

Indemnification

I agree to indemnify and hold harmless LFG Mobile Golf LLC and its representatives from any loss, liability, damage, or cost, including reasonable attorneys’ fees, arising out of or related to my participation in the activity.

Alcohol Acknowledgment

I acknowledge that participation may occur at venues where alcohol is served. I agree not to participate while impaired and understand that LFG Mobile Golf LLC reserves the right to refuse participation to any individual it believes may pose a safety risk.

Medical Condition & Conduct

I certify that I am physically able to participate and have no medical condition that would prevent safe participation. I agree to follow all posted rules and verbal instructions provided by LFG Mobile Golf LLC staff. Failure to do so may result in removal without refund.

Minors

Participants under the age of 18 must have consent from a parent or legal guardian. By allowing a minor to participate, the parent or legal guardian agrees to all terms of this waiver on the minor’s behalf.

Governing Law & Venue

This agreement shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, and any legal action shall be brought exclusively in a court of competent jurisdiction within Virginia.

Acknowledgment

By completing payment and/or participating, I acknowledge that I have read this Waiver & Release of Liability, fully understand its terms, and voluntarily agree to be bound by it.
